Entering settlements stemming from multi-regional CERCLA bankruptcy cases

One settlement document equals one credit. Each Region involved enters a settlement in ICIS and apportions the results of the case as appropriate. However, in terms of case conclusion credit, only one Region will get credit for a single judicial conclusion document. Civil actions follow the same guidelines and a lead Region, usually determined by where the complaint and conclusion are filed, receives the civil judicial conclusion. The lead Region in a bankruptcy case will receive the bankruptcy conclusion credit and the lead is determined on a case-by-case basis.

In October 2002, OECA’s JP Suarez AA, issued new case counting guidance. OECA was no longer comfortable with counting one conclusion as more than one - regardless of the number of facilities, the number of media, or the number of Regions.
