SDWA §1431 Emergency Powers Enforcement Actions

Purpose:  Until recently there was only one law section violated choice in ICIS for entering SDWA §1431 emergency power enforcement actions.  This was a problem because OECA counts SDWA actions in two programmatic categories: Underground Injection Control (UIC) and Public Water Supply (PWS).  A SDWA §1431 order could address an environmental problem associated with either the UIC or PWS programs but with only one §1431 choice we could not easily tell which was being addressed.

 

Data Entry:  There are now two law section violated choices in ICIS for entering SDWA §1431 emergency power enforcement actions.  Users should use the appropriate law section and program description depending on which SDWA program is involved:  SDWA 1431-UIC: Emergency Powers/UIC or SDWA 1431-PWS: Emergency Actions-PWS, USDW.

 

Data Retrieval:  Revised ICIS national standard reports will now sort these §1431 actions in the proper categories: SDWA UIC or SDWA PWS.
